Health Services Firm Settles Medical Malpractice/ Negligence Lawsuit
Malpractice News: In October 2008, The Albuquerque Journal reported that a lawsuit against a health services firm alleging medical malpractice and negligence had been settled.
The case involved a five year old girl who was treated at an urgent care center in Lovelace, New Mexico. The child’s mother was transporting the child from that facility to the University of New Mexico Hospital for emergency treatment. The girl died while in route to the hospital.
After an autopsy, it was determined the girl had developed myocarditis, an inflammation of the heart muscle caused by an infection. More than 70 percent of patients survive the infection. However, in this case the girl’s condition was unstable, and she required stabilization with a bag mask.
The child’s family learned that the nurse treating the girl at the urgent care center was intoxicated while on duty and had also been intoxicated at a class held only a few days before the girl’s death where bag mask procedures were covered. The family also discovered the nurse had a long-standing alcohol abuse problem, and had been re-hired by the urgent care facility despite her alcohol problems.
