Malpractice News: Woman Files Lawsuit Againts Insurance Company After Contracting Hepatitis C
Malpractice News: In September 2008, a 70 year-old woman from Las Vegas, Nevada filed a lawsuit against her health insurance carrier after contracting the Hepatitis C virus. The lawsuit alleges the insurance company was negligent in monitoring the practices of the physicians and clinics in their network.
The woman alleges that because of limits regarding where she could seek medical treatment, she was twice directed to a facility for gastrointestinal diagnostic testing, even though both federal and state health officials reported the facility practicing unsafe medical practices between March 2004 and January 2008.
The Centers for Disease Control (CDC) and the local health district investigated the facility, and found that syringes were being reused in a way that contaminated vials of medication, which patients to Hepatitis B, Hepatitis C and the HIV virus. The Southern Nevada Health District contacted over 60,000 former patients advising them to be tested for the viruses.
The woman was one of 400 former patients of the facility have tested positive for Hepatitis C. None of the facility patients have tested positive for either Hepatitis B or the HIV virus.
