Washington jury awards family $4.25 million for negligent birth
October 13, 2008 – A King County jury in Washington awarded $4.25 million last week to the family of a 5-year-old girl as a result of her injuries suffered at birth, and attributed to the medical malpractice and negligence of a local hospital in Kirkland, the Seattle Times reported.
According to the medical malpractice lawsuit, on May 30, 2003, the hospital staff allowed the only on-duty obstetrician to go home for dinner despite knowing a high-risk maternity patient was checking in. According to the suit, the nurses did not call the doctor back to the hospital despite observing signs that the unborn baby was in distress.
The baby was born after suffering oxygen deprivation, causing severe brain damage and cerebral palsy. The child, who is now 5, cannot walk, talk or eat through her mouth, according to reports. The jury award will provide medical care for the rest of her life.
