Medical malpractice jury verdict: No amount will adequately punish Pittsburgh hospital
July 22, 2008 – A Pittsburgh jury in a medical malpractice case awarded the family of a 24-year-old Ernst & Young accountant $2.5 million in wrongful death damages after a local hospital was charged with providing below-standard medical care that led to the patient’s death one week after he was admitted.
The patient died after his brain abscess allegedly was not treated in time by the staff at the Pittsburgh hospital. Pursuant to the procedures of verdicts and settlements, the plaintiff’s attorneys will now seek damages for the family based on the accountant’s lost earnings.
The malpractice lawsuit was tried in Allegheny County Common Pleas Court before a 12-member jury in May. The jury said in its May 23 verdict that “no amount of damages will adequately punish” the hospital, the University of Pittsburgh Medical Center at Shadyside.
Attorneys are now seeking a new trial limited to damages under the Survival Act. Plaintiff’s experts said the accountant’s lost earnings capacity was between $4 million and $15 million.
