“Boils down to a battle of the experts,”
says Appeals

May 27, 2008 – The Mississippi Supreme Court has agreed to hear a medical malpractice case after a state Appeals Court said the dispute hinges on “a battle of the experts,” the Associated Press reported.
The medical malpractice complaint involves a doctor and clinic that were sued by a woman who accused them of substandard postoperative care after a hip replacement.
Medical malpractice cases rarely go this far up the judicial ladder. That’s because disputes of this kind are aired sufficiently in trial court, and conclude with a verdict or settlement. There are many types of medical malpractice situations that warrant consultation with a personal injury lawyer.
The woman in this particular case received a second opinion from another doctor who said her hip muscle was not properly stretched through post-surgery physical therapy, which led to physical problems, including her right leg being 1-1/2 inches longer than her left leg.
The Supreme Court agreed to hear this appeal from the defendants.
