Malpractice News: Doctors with Alcohol Abuse Problems Can Continue Practicing During Rehab

Malpractice News: We depend upon our doctors to make reasoned and appropriate decisions for our healthcare. Unfortunately, like thousands of Americans, doctors are not immune from alcohol abuse. However, when doctors enter into a rehab program, virtually every state has confidential programs that permit doctors to continue practicing as long as they follow their treatment regimen.

In some cases, a doctor’s abuse problem can have serious and sometimes fatal consequences:

  • In Montana, a patient accused a doctor enrolled in the state's treatment program of not following up on her abnormal test results, delaying the diagnosis and treatment of cancer for more than a year.
  • A surgeon in North Carolina enrolled in the state's alcohol program charged patients for one type of gastric bypass, but performed a shortcut procedure leading to serious health complications for those patients.
  • A California plastic surgeon was accused of negligence by the state medical board. In 1999, the doctor performed a double mastectomy and breast reconstruction surgery, leaving the patient with infected wounds that wouldn't close, ultimately leaving the patient with a large lump caused by organs spilling through an unhealed hole in her abdomen.
