Massachusetts jury orders doctors to pay $26.5 million in baby malpractice case
October, 2007 – In one of the state’s largest medical malpractice verdicts involving a baby, a Massachusetts jury ruled that doctors must pay $26.5 million in damages to the parents of their son whose cerebral palsy was caused by dangerous delays during his delivery 10 years ago.
According to the Boston Herald, a Suffolk County jury ruled that doctors at Brigham and Women’s Hospital were negligent during the birth of a Brockton couple’s son, who today requires a feeding tube to eat. During the verdicts and settlements phase of the trial, the jury decided on the amount of damages based on the 10-year-old's future needs.
Due to the hospital’s negligence, the couple’s son will require special care for the rest of his life the jury found.
