Malpractice News: Investigation of 15 Year Old Boston Boy’s Death when Ventilator Fails

Malpractice News: During a two hour blackout that occurred in early July 2008 in Boston, Massachusetts, a 15 year old boy suffering from cerebral palsy, muscular dystrophy and mental retardation died due when his ventilator failed during the power outage.

During the investigation of the boy’s death, the Boston police and District Attorney's office turned over the allegedly faulty device to the manufacturer to be examined. The District Attorney’s office stated the company was required by the FDA to examine the device and report their findings, and that the preliminary findings indicated the device’s backup battery failed to operate.

According to the boy’s mother, the serial number of the device correlated to a 2004 recall of over 10,000 of the devices because of the potential for the backup battery to fail. The family received the ventilator from the contractor for the Massachusetts low-income health insurance program.
