EMS Malpractice Case in Ohio
A medical malpractice/wrongful death lawsuit has been filed against an Ohio EMS company by the parents of a West Virginia child who died during transport to a hospital in southwestern Pennsylvania.
In this case, a two year old boy was brought to the emergency room of an East Liverpool, Ohio hospital with complaints of shortness of breath due to wheezing and a croupy cough. The hospital ER staff made the determination to intubate and sedate the child, and have him transported via EMS to Children’s Hospital in Pittsburgh.
The lawsuit alleges that the EMS personnel were told to ensure the boy remained immobile and that the air tube did not move during transport, and should the boy try to move, to sedate him for the trip.
Unfortunately, the child was not restrained, which allowed him to move and caused his air tube to dislodge. The child was deprived of oxygen, went into cardiac arrest and was brain dead upon arrival at the hospital.
