Virginia jury awards $3.5 million malpractice verdict after foot surgery goes bad
June 3, 2008 -- A jury in Virginia awarded a $3.5 million malpractice verdict to a woman who sued her podiatrist over surgery that she says caused the amputation of the front of her right foot, The Roanoke Times reported today.
The verdict is a larger sum than the $3 million the plaintiff originally sought.
Though her medical bills and lost wages totaled $2.25 million, the plaintiff may not receive the full verdict amount because Virginia has a state cap of $1.6 million on medical malpractice awards.
The defendant reportedly caused her patient to have the front of her right foot amputated when it did not heal correctly after surgery to remove a bunion. The woman now lives on disability and uses a wheelchair or crutches to get around.
