Milwaukee mother settles malpractice birth for $18 million;
Left alone without a doctor, despite gestational diabetes
July 17, 2008 -- A Milwaukee woman with a history of gestational diabetes has accepted an $18.2 million malpractice settlement from the federal government after a traumatic birth injury 10 years ago that left her daughter with a severe brain injury.
The woman received care during her pregnancy through a federally funded program for the poor, but, despite a history of having large babies and gestational diabetes, she was not referred to an obstetrician or a specialist, prompting her claim of medical malpractice.
The Milwaukee Journal Sentinel reported that she went to the former Sinai-Samaritan Hospital to deliver her baby in 1998, but was left for more than 12 hours alone without a midwife or a doctor to attend to her. During her daughter’s birth, the baby was stuck for more than 20 minutes in the birth canal and suffered severe brain injury because of a lack of oxygen.
Two years ago a U.S. district court judge awarded the woman and her daughter nearly $21 million in damages. The lower figure was negotiated to avoid an appeal. Her daughter’s condition will require future medical expenses in excess of $12 million.
