Tennessee jury awards woman $3 million in mammogram malpractice lawsuit
A 41-year-old Tennessee woman with terminal breast cancer won a medical malpractice verdict of nearly $3 million on May 19, 2008, after her doctor misdiagnosed her mammogram, according to the Knoxville News Sentinel.
The doctor diagnosed the X-ray as showing a non-malignant calcification, when in fact it was a small tumor.
The woman reportedly waited three years to have another mammogram, and learned then that she had a very large tumor that had spread to her liver. She was diagnosed with Stage IV, and given a year to live; three years at the most.
If she had been properly diagnosed, her chances of being cured would have been 90 percent.
She issued this statement after the verdict: “I hope that the decision will send a message insisting on proper medical care and the importance of women taking an active role in their health care. Mammograms are very important and early detection is key.”
