$2.27 million verdict in midwife malpractice case
April 26, 2007--As stated in an article in The Sentinel Reporter, a $2.27 million verdict handed down in a midwife medical malpractice lawsuit may be the largest verdict ever awarded by a Cumberland County jury in a personal injury matter.
A baby born eight years ago, and delivered by a midwife, had severe brain damage and spastic cerebral palsy, according to news reports.
The plaintiffs charged the baby's condition was caused by the midwife's negligent failure to recognize obvious signs of fetal distress during labor. The jury agreed, handing in a verdict that found her negligent and a substantial factor in bringing about harm to the baby.
