Malpractice: Federal Drug Law in “Pill Mill” case
In a May 2008 case being investigated and argued in Wichita, Kansas, the prosecutors were defending the constitutionality of the Federal Controlled Substance Act in a "pill mill" case involving a Kansas physician charged with criminal malpractice by prescribing painkillers that were linked to 56 overdose deaths.
The doctor and his wife, who worked as a nurse, were charged with a number of federal charges, including conspiracy, unlawful distribution of controlled substances, health care fraud, illegal money transactions and money laundering. The state’s case also charges the couple with directly causing the deaths of four patients and contributing to the deaths of 11 other patients.
According to a Department of Justice press release issued after the couple were arrested in December 2007, the doctor’s clinic was a “pill mill” open 7 days a week. The doctor, his wife and other employees were charged for illegally writing prescriptions for narcotic painkillers, including Fentanyl, Methadone, Morphine and Oxycodone. The clinic had billed more than $4 million to health benefit programs.
