$1 Million Ruling in Wisconsin Malpractice Case
July 7, 2008 -- The decision maintains an earlier ruling that a Wisconsin insurance company must pay malpractice damages and costs to the estate of a man who died of cancer in 2003.
Family members filed a lawsuit claiming two doctors neglected to diagnose his condition.
The insurance company provided insurance to the doctors, and the clinic that employed them, which were named as defendants.
The doctors and the clinic denied the claims in court but the insurance company never responded, which the company called an oversight.
The court ruled in a 4-3 decision that the insurance company was in default and mandated that they pay the damages.
