Medical malpractice cases on the rise, says West Virginia Medical Association
August 27, 2008 — Medical Malpractice News: When a 62-year-old West Virginia man underwent surgery to install an implantable cardiovascular defibrillator, the hospital’s anesthesia team failed to notice deteriorating vital signs. Their oversight led to oxygen deprivation and severe brain damage. The man died.
Upon her husband’s loss, his wife filed a malpractice lawsuit against the hospital where the surgery was performed charging negligence and medical malpractice.
The jury agreed with her, and awarded the woman $1.54 million.
West Virginia medical malpractice cases escalate
These scenarios are not uncommon in West Virginia, where the state’s medical association reported this month that the number of medical malpractice cases against state doctors and hospitals is rising, once again.
According to association data, 315 medical malpractice cases were filed in 2003. Malpractice cases rose from 130 in 2004 to 174 last year — representing a 34 percent increase.
