Medical malpractice lawsuit filed against Ohio EMS in death of 2-year-old boy

July 28, 2008 – A medical malpractice suit involving the death of a two-year-old boy, while in the custody of emergency ambulance personnel, was recently filed in Hancock County (Ohio) Circuit Court against Lifeteam EMS, Inc.

According to the family’s malpractice lawsuit, the boy was brought to the emergency room of East Liverpool City Hospital complaining of increased shortness of breath and a cough. He died while being transported by Lifeteam EMS personnel from East Liverpool City Hospital to the Children's Hospital of Pittsburgh.

The boy’s parents accuse the EMS company and four employees of “negligence, willful misconduct, medical negligence, and acts and omissions that fell below the standard of care” and caused their son to die.

That negligence is said to include: improper IV monitoring, failure to divert to a closer hospital to assist with a dislodged air tube, and failure to notify the Children's Hospital emergency room prior to arrival.

The lawsuit will be heard at the United States District Court for the Northern District of West Virginia. A pretrial conference/final settlement conference has been scheduled in District Court on Aug. 10, 2009, and jury selection is slated to begin Aug. 25, 2009.
