Settlement in Illinois Malpractice Suit
In May 2008, an Aurora, Illinois woman entered into a settlement with a physician and hospital in her malpractice lawsuit stemming from problems when her son was born in 2001. The $15 million settlement is considered one of the largest medical malpractice settlements in the state.
While the woman had an uneventful pregnancy and what appeared to be a routine labor, her physician used a vacuum extractor device over 18 times during the last hour of her labor. As a result, the woman underwent an emergency caesarean section. As a result of the child’s birth defect injuries, he suffers from both cerebral palsy and retardation.
