$24 million awarded for traumatic kidney stone operation
July 25, 2008 – An Illinois man and father of two was recently awarded $24 million in a medical malpractice case that he brought against the doctor and nurse that treated him during kidney stone surgery, but left him in a wheelchair for the rest of his life.
According to charges in his malpractice lawsuit, the man experienced an oxygen interruption that caused him to lose most of his fine motor skills. He was undergoing surgery for kidney stones when he had a heart attack, according to his attorney.
The man is now confined to a wheelchair, suffering from spastic movements, severe double vision and slurred speech, making him difficult to understand. Married, with two children, the plaintiff worked for a phone company before the traumatic surgery.
The jury was shown a videotape of a day in the man’s life, which his attorney said impressed upon jurists the daily struggles he now contends with.
In addition to the $24 million jury award to help cover his future medical services and lost wages, the plaintiff settled out of court with another doctor and nurse for $1 million each.
