In November 2008, a Seattle man diagnosed with mesothelioma is challenging a King County, Washington court rule that requires mesothelioma victims to undergo an autopsy after they die for their case to proceed after their death.
Mesothelioma is an extremely serious form of cancer that occurs from exposure to asbestos. Patients who contract the disease typically pass away within one year of diagnosis.
The man, who claims no religious or other objection to autopsy, has taken the issue to court on his right to have his final wishes respected and fulfilled without taking away his family’s rights to seek compensation for his illness and continue the lawsuit.
A hearing was held in late October 2008, and the judge in the case promised a written ruling within one week.
