Mesothelioma Attorney

A Weitz & Luxenberg attorney can help you obtain substantial financial compensation if you have been diagnosed with an asbestos-related disease such as mesothelioma cancer.

Malignant mesothelioma is caused by asbestos exposure, which most often occurs at industrial job sites where employers are negligent in protecting their workers’ health safety.

Asbestos-based products are known to release toxic fibers into the air when they are involved in certain work activities, such as drilling, cutting, sanding or spraying. Once asbestos fibers are released, they can remain airborne for long periods of time and accidentally inhaled.

Why hire a mesothelioma attorney?

Malignant mesothelioma cancer is preventable. All that is needed to prevent asbestos exposure is protective equipment, such a mask or respirator. Unfortunately, many companies in the asbestos industry failed to provide protective gear, though they knew about the dangers of asbestos exposure. A mesothelioma attorney can obtain compensation for asbestos-injured workers to help them pay for medical expenses, lost wages and suffering.

Is it expensive to hire a mesothelioma attorney?

Most asbestos attorneys work on a contingency basis. In a contingency fee system, the mesothelioma attorney does not charge the client anything until he/she obtains a settlement or verdict for the client. Once a settlement or verdict is obtained, the mesothelioma attorney takes a small share e.g. one-third, as the legal fee.

The remaining share of the mesothelioma settlement or verdict is given to the client. If the attorney is unable to win a settlement or verdict, he/she/the law firm does not get paid and the client is not charged anything. Thus, you generally do not need to worry about cost when choosing a mesothelioma attorney.

Occupational asbestos exposure cases

If you are among the many workers whose job-related asbestos exposure led to malignant mesothelioma we urge you to discuss your case with one of our firm’s attorneys.

Weitz & Luxenberg has built its practice on asbestos litigation. Every mesothelioma attorney in our Asbestos Litigation Unit has had repeat success in obtaining large financial awards for their clients.

The firm has enjoyed numerous victories in recent years defending asbestos-injured workers. Here is a recent example.

On June 27, 2008, Weitz & Luxenberg P.C. mesothelioma attorneys obtained a $16.25 million dollar verdict in an asbestos lawsuit on behalf of Marvin Penn, 71, who was diagnosed with the asbestos-related cancer mesothelioma. The jury attributed 20 percent of the liability to the sole defendant at trial, Kerr Corp., a dental tape supply company. The case is believed to be the first successful asbestos verdict against that type of defendant.

Marvin Penn was a mail carrier from 1963 to 1999. While considering a career change, he attended dental technician school in the late 1960s. It was there that he was exposed to asbestos while making castings by carving wax replicas of teeth using asbestos-containing dental tape.

The complex case (Index no. 105637/07, New York Supreme Court, Manhattan) involved a three-week trial featuring state-of the-art medical experts, which culminated in the verdict against Kerr. The jury attributed 20 percent of liability to another dental supply manufacturer, Dentsply Corp, f/k/a Randsom & Randolf, which settled before the mesothelioma verdict.

The trial also addressed Penn’s other exposures to asbestos. He testified that he worked in a post office across from the former location of the World Trade Center while it was being sprayed with asbestos. The spray was found to be 40 percent liable in causing mesothelioma.

Additionally, Todd Shipyards was found 20 percent liable given that Penn’s father worked there as a steamfitter. Family members of workers exposed to asbestos are at risk due to the asbestos dust brought into the home on the shoes, clothing, skin, and hair of workers.

Many workers are at risk of developing malignant mesothelioma cancer from asbestos exposure. Shipyard workers, construction workers, welders and other workers may become diagnosed with mesothelioma cancer due to on-the-job asbestos exposure.
