Mechanics at Risk: New York City judge rules in asbestos case involving auto mechanic
In March 2007, a judge in an asbestos litigation case in New York City made a ruling in a case involving an auto mechanic that developed an asbestos-related disease as a result of exposure from working with asbestos-containing brakes.
One of the defendants in this case, Ford Motor Company, wanted to have their
training materials and videos excluded from evidence in this case. While they
claimed that their brake materials were safe, their materials included a warning
that they contain asbestos, and asbestos from brakes cause cancer and other
disease. Ford also claimed that the warning was on their materials so they would
be in compliance with standards required by the Occupational
Health and Safety Commission. In ruling against Ford, the judge stated that
Ford does not state that the warnings were on their materials “…solely for the
purposes of complying with government regulations.” The judge also noted that
since their training materials were also available to the public at
large.
