Since the April 2010 explosion aboard the doomed oil rig Deep Horizon, tens of thousands of property owners, business owners, as well as those who operate or work in the regions’ hotels, restaurants, and countless other businesses faced a summer of financial ruin caused by the massive oil spill.
In August 2010, the management of the $20 billion Gulf Coast Compensation Fund (GCCF) was assumed by Kenneth Feinberg. Since assuming the role, Mr. Feinberg first announced that claimants who owned businesses outside the Gulf coast would not be eligible for compensation. However, at a September 2010 meeting before the Florida Restaurant and Lodging Association, Mr. Feinberg addressed the issue and announced that all valid Gulf oil spill claims would be reviewed and considered.
Incomplete Claims Create Backlog
As part of Mr. Feinberg’s management of the daunting task of reviewing and allocating payments to claimants has caused a proverbial logjam because of incomplete submissions and those submitted without any documentation of past or anticipated financial losses.
According to a statement by Mr. Feinberg, the process has also been complicated by the submission of allegedly fraudulent claims. In an October 2010, statement, Mr. Feinberg advised that these fraudulent submissions would be directed to the U.S. Department of Justice (DOJ) for possible criminal investigation.
Legal Recourse is Available
Tragically, news reports about the claims process indicate that as of October 2, 2010, more than 35,000 of the Fund’s 98,000 claims are on hold because of a lack of documentation.
In order to assist claimants in the hospitality industry, the Florida Restaurant and Lodging Association (FRLA) announced the selection of a consortium of law firms to represent the interests of these individuals and companies to ensure their claims are complete, and therefore, can be reviewed and processed in a timely manner.
