Pain and suffering caused by Fosamax
“My right femur snapped in half and Fosamax was to blame,” said Jan, a 46 year-old woman who sustained multiple femur fractures after taking Fosamax once a week for 12 years. She was only doing as her doctor recommended, which was to be proactive and prevent osteoporosis. Now, she has had to endure the seemly endless pain and suffering of recovering from multiple broken bones, and the ever-present fear of breaking more. At one point after she sustained her first injury, she was watching Good Morning American and saw a report on femur fractures caused by Fosamax.
“Listening to Diane Sawyer talk, I felt shock on the one hand, but relief on the other—finally knowing the cause and that I wasn't alone. But I was furious. I was only trying to help myself and do what my doctor suggested.”
About seven years after being prescribed Fosamax, Jan started experiencing terrible pains in her right leg. These pains became so severe that at times she would be kept awake because of them. It was difficult for her to perform well at her job, and some days she wondered if she could even make it through the day.
“I was often in tears," says Jan about the leg pains.
Finally, after seeing doctors, physiotherapy, and a number of tests, she was given a spinal block (or epidural) and after a few weeks the pain just went away. What she did not know was that although the symptom was gone, the cause was not.
"In January 2006, I was helping my daughter move, and I put my right foot down to pick up a box. As I stepped over the box and pulled up my right leg I heard it crack, like a crunch. I knew something terribly wrong happened and I fell to the ground in excruciating pain.”
That was the sound of Jan’s femur (the largest and one of the strongest bones in the human body) snapping like plywood and splintering into her pelvis.
The doctors at the hospital to which she was administered could not believe the x-rays. They had not seen factures like Jan’s outside of car accidents.
Jan needed to have a steel rod placed in her leg and two plates in her knee. After a while of physical therapy, the doctors did not think Jan would be well enough for them to take the rod out. Jan persisted and after seeking out a specialist and switching to a very expensive bone healing medication called Forteo (which costs $1000 a month and is not covered by her insurance) she started to show improvement.
"On March 4, 2009, I had a bone graft from my pelvis to my femur…Finally [in] March 2010, the surgeon said my femur was healed and the rod could be removed.”
Then, Jan’s left leg started feeling funny. She went back to her specialist and it was revealed in a bone scan that she had another fracture, this time in her left femur.
"I was back on Forteo, but was warned that my left femur could break in two at any time. That's where I stand now. And I won't go anywhere, not even to the washroom, without my cell phone. I am terrified that my femur can break at any time. I am afraid to babysit my granddaughter; I feel like an invalid. My bones are so screwed up; my doctor said the average woman has a one in 10,000 chance of breaking a hip in their late 50’s. But my chance is one in three.”
Jan also needs to keep the rod in for life, which she says causes her great discomfort.
"Right now my right leg is one inch shorter than my left—you have no idea how much my life has changed. I used to work out three times a week. Now I can hardly walk in the shopping mall…My husband and I had so many plans for our retirement, golfing and tennis, but now I'm afraid to do anything," (Lawyersandsettlements.com).
Getting compensation for your pain and suffering
Fosamax has ruined Jan’s life. She had plans for retirement that she can never carry out. Even with all of her medical expenses paid for, there is no way to bring her back to the life she used to have. Pain and suffering is where, in legal terms, we attempt to grant compensation for non-monetary losses. Jan has the right to file a lawsuit against Merck & Co. (the manufacturer of Fosamax) for all medical expenses, and the pain and suffering she is constantly enduring because of their drug. Weitz & Luxenberg can only hope that the financial compensation awarded for pain and suffering may ease it considerably. Our skilled team of attorneys is prepared to aid those who have sustained serious injuries from Fosamax with a lawsuit against Merck & Co. We can help you get the compensation you deserve for the pain and suffering you had to endure.
