Weitz & Luxenberg wins $53.5 Million Verdict in Asbestos Personal Injury Case

National Law Journal, 3/4/2002

ON FEB. 8, 2002, a New York jury awarded a $53.5 million verdict in the personal injury case of a man who died from a cancer linked to asbestos exposure. Stephen Brown, an auto mechanic, was 51 when he passed away last year of mesothelioma. His wife, Patricia, individually and as the executor of his estate, sued nearly 30 companies. She settled with most, going to trial only against Bendix, a unit of Honeywell International Inc. Brown claimed that her husband developed mesothelioma as a result of his exposure to asbestos brakes and clutches manufactured by Bendix. Bendix argued that Brown was exposed to its products for only six months, not enough time to cause mesothelioma. The jury found Bendix reckless and that it had acted in concert with other companies that made asbestos-containing products to suppress information about the hazards of working with such products. The jury awarded $ 17,000,000 to the estate of Stephen Brown for past pain and suffering and $ 36,500,000 to Patricia Brown for loss of services. Brown v. Bendix, No. 120595/00 (New York Co., N.Y., Sup. Ct.). PLAINTIFFS'' ATTORNEYS: Michael P. Roberts, Jerry Kristal and Richard D. Meadow, Weitz & Luxenberg, New York
