A 38-year-old male construction laborer suffered a vertebra compression fracture at L2, along with a comminuted fracture of the os calcis of the right foot, when he fell aproximately 15 feet off of an unsecured ladder while under the employment of the defendant construction sub-contractor. Although the plaintiff did not sufferer nerve injuries related to the vertebra fracture, he did sustain substantial orthopedic injury to his foot, as a result of which he had a constant feeling of imbalance. The plaintiff claimed that he was only able to work 1,000 hours per year, as opposed to the 1,500 hours per year that he worked prior to the accident. The plaintiff contended that the ladder he fell off of was not properly secured to the beam it was leaning against, as was required by normal safety procedures, and that it did not extend two feet above the beam as was required by procedure either. The court directed a verdict against two of the contractors involved in the suit, with the jury apportioning 90 percent liability against the plaintiff's employer, and 10 percent liability against another of the co-defendant contractors. The $505,000 jury award included $50,000 for past pain and suffering, $100,000 for future pain and suffering, $88,000 for past lost earnings, and $267,000 for future lost earnings.
