The project was initiated after a massive flood in June, 2008, caused the breach of a soil levee on property owned by Pfizer Inc.
That's when an estimated 300 million gallons of floodwater from a 900-acre watershed surged into a small containment pond that was part of Pfizer’s wastewater treatment plant. The floodwaters overwhelmed the small 3-acre pond, sending chemically-laden soil pollution downstream into Jordan Creek and across residential property lines in Indiana’s Vigo County.
“Many residents are worried and are reaching out for legal information, as well as health information,” said Robin Greenwald, head of the Weitz & Luxenberg Environmental and Toxic Torts unit. “We want to share our knowledge with all Vigo County home owners affected by the toxic PCB spill.”
Vigo County property owners face more than water-damaged furniture. They must also contend with soil contamination from high levels of polychlorinated biphenyls (PCBs) that seeped into the ground. The accident prompted the U.S. Environmental Protection Agency (EPA) and the Indiana Department of Environmental Management to order a massive cleanup project.
Miles of toxic soil pollution
Concerned that Pfizer’s cleanup efforts would fail to restore ground soil or real estate values to pre-flood conditions, many local residents have asked that the state order Pfizer to buy out their property. Some are calling the PCB lawyers at Weitz & Luxenberg. According to the company, the cleanup project required the removal and replacement of some 70,000 cubic yards of soil along 3.2 miles of Jordan Creek.
Symptoms of PCB exposure
Despite Pfizer’s efforts, Jordan Creek residents are now reporting illnesses associated with PCB exposure, including skin conditions such as chloracne and rashes. Health authorities say symptoms can also include: changes in blood and urine (which may indicate liver damage), dermal and ocular lesions, irregular menstrual cycles, a lowered immune response, and poor cognitive development in children.
