Gulf Shore Oil Spill: Class Action Lawsuit Information and Resources
IMPORTANT: If your livelihood or property is affected by the Gulf Coast oil spill, we urge you to seek the advice of a lawyer before signing job applications or other documents. You may be signing away your legal rights to take part in a class action lawsuit.
On April 20, 2010, the tragic explosion and fire aboard the oil rig Deepwater Horizons resulted in injuries to a number of crew members and took the lives of 11 men working on the oil rig. Two days later, the oil rig sank, which caused an oil spill of epic proportions to spew over 210,000 gallons of oil into the Gulf each day since the disaster. As of May 12, 2010, it has been reported that over 4.1 million gallons are now polluting Gulf waters.
The investigation into the accident, cleanup and containment efforts is currently being led by the U.S. Coast Guard. Other federal agencies, including the Department of Homeland Security, the Department of the Interior and the Environmental Protection Agency (EPA) are also involved in the investigation and cleanup of the miles-wide oil slick.
On May 11, 2010, the U.S. Senate Committee on Energy and Natural Resources obtained testimony from representatives of TransOcean, the owner of the oil rig, BP Oil and Halliburton regarding the oil spill disaster. On May 18, 2010, the Committee will conduct a full hearing in order to obtain testimony from the Administration on issues related to offshore oil and gas exploration and the Gulf oil spill.
Class Action Lawsuit Filed
The attorneys in Weitz & Luxenberg’s environmental litigation unit, along with a consortium of other law firms, filed a class action lawsuit (Case Numbers 3:10-cv-00137-MCR-EMT and 2:10-cv-01229-KDE-SS) against BP, Halliburton, Cameron and other entities on behalf of commercial fishermen whose livelihoods will be seriously impacted by the oil spill.
Other Gulf State Residents Affected
Since the class action lawsuit was filed, our lawyers have spoken to a number of commercial fishermen, business owners and other affected individuals from the gulf areas of Texas, Louisiana, Alabama, Mississippi and Florida.
In addition to fears of property damage should the oil slick reach the shores in many Gulf coast towns, the financial implications for the owners, operators and employees of marinas, hotels, vacation condominium and time share complexes are all fearful of lost revenue should summer vacationers cancel trips to the region.
The loss of tourist revenue will also be felt by those who own and work at restaurants, gift shops, recreational fishing, snorkeling and scuba excursion vessels, as well as the businesses that rent scooters, bicycles and other equipment used by beach vacationers.
