Tobacco Makers Lose Key Rulings on Latest Cigarettes Class Action Lawsuits


In a September 2006 ruling, a federal judge in Brooklyn, NY ruled that smokers of light cigarettes can go forward with their fraud claim as a class action lawsuit because the cigarettes were advertised to the public as being safer than regular cigarettes.

According to the New York Times, the decision raises the possibility that so-called lights cases will become a major threat to tobacco companies and expose them to potentially significant damages.

The judge in this case, Jack B. Weinstein of Federal District Court in Brooklyn, found "substantial evidence" that the manufacturers knew that light cigarettes were at least as dangerous as regular cigarettes.
