Yaz and Yasmin birth control subject of FDA warning letters on misleading advertising

A lawyer may be able to help if Yaz or Yasmin birth control pills caused harmful side effects

In February 2009, the Food and Drug Administration (FDA) and the attorneys general of 27 states required that Bayer run new ads to correct its previous marketing of Yaz birth control pills.

The FDA first took issue with the Yaz campaign last October, sending a warning letter to Bayer saying that two television ads overstated the drug’s benefits while understating its risks, according to the New York Times.

This is not the first time, however, that health groups and government officials have faulted birth control commercials as being misleading. In 2003, the FDA sent a warning letter to the manufacturer faulting its ads for Yasmin, the precursor to Yaz, for implying the pills were superior to other oral contraceptives and for minimizing risks specific to the drug.

The letter said, "Specifically, the 60-second TV ad entitled "Goodbye Kiss" is misleading because it makes implied clinical superiority claims to other combination oral contraceptives and minimizes the important risk information that distinguishes Yasmin from other combination oral contraceptives. As a result, the TV ad raises significant public health and safety concerns."

Some of the side effects attributed to Yaz and Yasmin are:

  • Death
  • Blood clots in the legs (DVT or Deep Vein Thrombosis)
  • Blood clots in the lungs (PE or Pulmonary Embolism)
  • Portal Vein Thrombosis and blood clots in other veins
  • Stroke
  • Heart attack
  • Gall bladder complications requiring surgery
