In recent news about Yasmin litigation, a woman filed a liability lawsuit involving Bayer's Yasmin birth-control pill.
Reportedly, Bayer faces more than 125 lawsuits for Yasmin, which received FDA approval in 2001, and the newer YAZ, which was introduced in 2006, according to Courthouse News Service.
The latest suit involves a woman who claims that after taking a combination of Yasmin and YAZ for two months in 2007, she is at greater risk of serious side effects, including heart arrhythmia, myocardial infarction, stroke, blood clots, embolisms, and kidney or gall bladder disease.
Bayer claims that Yasmin/YAZ is tested and safe, but it never studied the drugs' effects in clinical trials, according to the complaint.
The woman's Yasmin lawsuit alleges that Bayer used safety information from other oral contraceptives; she says the FDA warned Bayer three times about misleading the public through TV ads that overstate the drug's efficiency and minimize its risks.
Earlier this year, the Food and Drug Administration (FDA) sent a warning letter asking Bayer to correct misleading television commercials.
The Division of Drug Marketing, Advertising, and Communications (DDMAC) reviewed two 60-second TV Ads entitled "Not Gonna Take it" and "Balloons" for Yaz tablets and said, "The TV Ads are misleading because they broaden the drug's indication, overstate the efficacy of Yaz, and minimize serious risks associated with the use of the drug."
The FDA added, "These violations are concerning from a public health perspective because they encourage use of Yaz in circumstances other than those in which the drug has been approved, over-promise the benefits and minimize the risks associated with Yaz."
