News of the defective cups came to a head in Spring 2008, when orthopedic researcher and surgeon, Dr. Larry Dorr, delivered a speech to the American Association of Hip and Knee Surgeons. Dr. Dorr stated that the primary reason for the product’s failure was poor construction. “We do not believe the fixation surface is good on these cups,” he said. “When we hit on the edge of the cups, they would pop out of the hip socket. Also, there is a circular cutting surface on the periphery of the cup that we believe prevents the cup from fully seating.”
Instead of accepting responsibility for the pain, Zimmer Holdings Inc. blamed the widespread failure of their product on surgical negligence. Yet when Zimmer was informed of the implants’ defects in 2007 (a year after the cups debuted), an entire year passed before the company conducted any investigations.
