Weitz & Luxenberg has filed a class action lawsuit against Primo Brands Corporation and BlueTriton Brands, Inc. (together, Primo) on behalf of several named plaintiffs and many thousands of consumers nationwide. The lawsuit alleges that consumers have been impacted by significant and frequent disruptions to Primo’s water delivery service, and that Primo has overcharged many of its customers and blocked or ignored their attempts to cancel service.

Primo offers its water delivery service as a subscription that consumers can sign up for online, over the phone, and at certain retail stores. The lawsuit alleges that Primo subscribers have encountered missed or delayed scheduled deliveries, wrong or incomplete orders, and failure to pick up or replace empty bottles and equipment.

In many cases, Primo has charged consumers for goods and services that it did not deliver to them or that they did not order. Primo has also made cancellation of subscriptions extremely difficult. Worse, many subscribers have continued to incur charges and fees after cancellation attempts.

Delivery Service to Customers Deteriorated After Merger

In November 2024, Florida-based Primo Water merged with Connecticut-based BlueTriton to form Primo Brands Corporation. Primo Brands has approximately 3 million customers and earns billions of dollars per year in revenue.

Primo Brands has admitted that the merger led to “self-inflicted” delivery disruptions. It has conceded that there were “integration issues related to the technology,” product supply disruptions, and “warehouse closures and route realignment” issues. (1)

Consumer complaints about Primo to the Better Business Bureau (BBB) and other sources have surged since the merger. Primo Brands has a D- rating with the BBB and has been the subject of nearly 3,000 BBB complaints in the past 3 years, many of which came after the merger. (2)

W&L’s lawsuit claims Primo has misrepresented that its delivery services are reliable and easy to cancel, and “caused consumers to experience missed and repeatedly delayed deliveries; charges for goods and services that it did not deliver to them, or that they did not order; improper fees and penalties, for example, for bottles and equipment that Primo itself failed to pick up; broken or severely deficient customer service channels for resolving disputes and cancellation requests; and in some instances, ongoing charges even after consumers have requested to cancel services.” (3)

Consumer Class Action Claims

The class action lawsuit filed by W&L seeks compensation for widespread and ongoing harm to consumers. The legal claims include:

  • Consumer fraud.
  • Statutory auto-renewal law and “junk fee” law violations in California and elsewhere.
  • Negligence.
  • Conversion.
  • Unjust enrichment.

In addition to a class of consumers wronged by Primo’s business practices nationwide, the lawsuit includes subclasses of affected consumers under California, New York, Colorado, Georgia, Illinois, Indiana, Nebraska, New Jersey, and Ohio law.
