Weitz & Luxenberg attorneys are accepting clients who were victims of the fire that occurred at the Moss Landing Vistra battery plant. It happened in Northern California on January 16, 2025.

We are seeking compensation on behalf of residents with physical injuries — including from toxic fumes — as well as property damage.

Compensation for this lithium-ion battery fire could also include damages to cover the lost use of your home, any costs you incurred with having to evacuate, and reimbursement for the time you had to spend away from work.

Residents in Northern California at Risk

“We are particularly concerned about people living near the Moss Landing battery plant,” says Devin Bolton, an attorney in W&L’s Environmental, Toxic Tort, & Consumer Protection litigation unit. “The fire and explosions that occurred are dangerous. And any exposure to toxic fumes and gas can lead to serious respiratory problems.”

She continues, “In addition, we’re monitoring the site for any hazardous substances that might lead to poisonous water runoff. Our team at Weitz & Luxenberg is acting quickly to get victims of the fire the help they need.”

The areas most directly impacted by the Moss Landing Vistra battery plant fire include:

  • Moss Landing.
  • Monterey county.
  • Santa Clara county.
  • Santa Cruz county.
  • San Benito county.

Hazards of Lithium-Ion Batteries

Lithium batteries pose some significant hazards. In storage, they can: (1)

  • Overheat, leading to thermal runaway.
  • Explode, causing fires.
  • Release toxic substances, resulting in dangerous plumes.
  • Lead to toxic runoff, from rain or attempts to suppress the release.

The county of Monterey responded to the Moss Landing Vistra battery plant emergency on the first day of the fire. The U.S. Environmental Protection Agency (EPA) was brought in on the second day. Monterey County reported that it was monitoring for toxic gas fumes. (2)

W&L Faces Off Against Environmental Offenders Nationally

One of Weitz & Luxenberg’s specialty litigation areas is environmental pollution and the catastrophes related to it. Here are just a few we are handling:

  • BioLab chemical plant fire in Georgia: W&L is on the leadership of this ongoing litigation. The fire at a BioLab plant released the toxic chemicals chlorine and bromine, as well as dark smoke, all over Atlanta. Tens of thousands of people had no choice but to evacuate their businesses and homes.
  • Train derailment, explosion, and fire in Ohio: A settlement resulted in a $600 million win for victims, and W&L was on the leadership committee. The disaster occurred close to the Pennsylvania border. Tens of thousands of people were affected. The train was carrying numerous combustible materials and toxic chemicals. Pressurized tanks spewed toxins for miles.
  • Gas leak blowout in California: A settlement of up to $1.8 billion was reached by W&L and other members of the plaintiff’s leadership committee. The gas leak occurred in SoCalGas’s Aliso Canyon gas storage facility. Natural gas from underground storage wells leaked into the communities of Porter Ranch, Northridge, Chatsworth, and Granada Hills. The disaster was so bad that residents, schools, and businesses had to evacuate for four months. Several thousand residents were injured.
