Weitz & Luxenberg has filed a class action lawsuit against Google, LLC, and YouTube, LLC, on behalf of YouTube Premium subscribers nationwide. The lawsuit states this class of viewers paid for ad-free streaming video with no interruptions. But subscribers are still subjected to frequent, and sometimes lengthy, advertising and interruptions.
These viewers specifically chose to pay a monthly fee to avoid being bombarded with advertising. They were promised ad-free streaming. However, they are still subjected to numerous ads and other interruptions that disrupt their listening and viewing experience.
W&L is seeking a jury trial. We filed this class action suit on July 14, 2026, in the United States District Court, Northern District of California. One proposed class is for California and the other is Nationwide.
Lawsuit Seeks Damages and Relief from Ads
In our lawsuit, our clients are seeking to “put a stop to YouTube’s false statement that Premium service comes with no ads and no interruptions,” says W&L partner James Bilsborrow, co-chair of our firm’s consumer protection practice group.
“They paid for a premium service to escape the constant, never-ending ads and interruptions on YouTube. However, they continue to be subjected to frequent commercials and disruptions. This is a far cry from the ad-free experience they were expecting.”

YouTube not only offers free streaming, it is also considered one of the most popular worldwide video platforms. Viewers watch and search for billions of videos that provide content on almost every topic or subject you can imagine.
The downside is that viewers are constantly bombarded with all kinds of advertisements in many different formats. Some ads last seconds, while others last over 30 seconds. Some you can manually choose to skip. With others, you have no choice but to be patient until the commercial ends.
The plaintiffs in our class action chose to purchase YouTube Premium for a monthly fee. This service supposedly provides ad-free video and music streaming. YouTube introduced Premium back in 2018, in response to YouTube viewers tired of the flood of ads. The cost back then was $11.99 per month to new members. The current price is $15.99 per month. YouTube viewers looking for ad-free content and annoyance-free viewing determined this expense was reasonable and purchased YouTube Premium.
However, according to our lawsuit, “This promise is hollow.” YouTube Premium viewers say that “advertisements and interruptions frequently appear during streamed content, interrupting videos with commercials” for all kinds of services and products that have nothing to do with the content they were viewing.
