According to Stefano Corazza, Roblox’s Studio head, “Like, you can say, ‘Okay, we are exploiting, you know, child labour,’ right? Or, you can say: we are offering people anywhere in the world the capability to get a job, and even like an income.” (1)

The allegations in this Roblox child labor lawsuit center on the company’s reliance on child labor to build its platform. Many of these users are children under the age of 16. Roblox not only failed to protect children — it doubled down on the very design choices that made exploitation inevitable, profiting the entire way. How Roblox DevEx Claims Children Can Earn Money
On the Roblox platform, the company’s Developer Exchange program (DevEx) allows users to monetize the games and experiences they create. Roblox promotes this opportunity to children as a way to convert any Robux — the platform’s virtual currency — earned from the sale of the virtual content they create into real U.S. dollars. And it encourages and provides the tools for minors to work for adult developers on its platform. Many parents are unaware that children can spend hundreds or even thousands of hours creating games through Roblox’s Developer Exchange Program (DevEx) without the compensation they’ve been promised.
To be eligible to participate in the DevEx program, users must be at least 13 years of age. They also must agree to the DevEx Terms of Use, meet the eligibility requirements specified, and have earned at least 30,000 earned Robux from their experience or virtual content sales. The site says this is the current “cash out” minimum threshold.
Only Robux earned through monetized games or virtual content sales can be cashed out. To initiate a cash-out, a creator must submit a request in the “Creator Hub,” which triggers a review by the DevEx team. If approved, the creator then receives an invitation to the DevEx portal, where they provide tax and payment information. After doing this, they can seek payment. The current standard exchange rate is much less than a penny per earned Robux.
Roblox Promotes DevEx as a Way for Children to Earn Money
While Roblox claims that its platform is a “safe” place for children and that “Safety is in our DNA,” these are mere platitudes. In reality, Roblox’s business model requires children to work for and purchase its digital currency. And this is only possible by promising these users compensation for their time and effort, as Roblox’s company slogan acknowledges: “Make Anything. Reach Millions. Earn Serious Cash.” Even its DevEx marketing materials lure children to “Build your own games and make tons of money!”
Roblox Promises Earnings, But Few Children Get Paid
According to Roblox, you have to be at least 13 to become a member of DevEx, and must have a minimum amount of earned Robux in your account to cash out.
The cash-out process is exceedingly convoluted. And, the small percentage of children who make money start by paying $0.0125 to purchase Robux to participate. When children cash out, Robux are worth just $0.0035 or $0.0038 each. The valuation spread is around 3.5 to 1. Roblox always comes out ahead.
In addition, Roblox does nothing to ensure that its adult DevEx developers comply with state and federal labor laws.
The lawsuit alleges that Roblox’s system creates an environment where children perform work-like activities without the protections required under child labor laws.
The Lawsuit Alleges Roblox Violated Child Labor Laws
Roblox violates the Fair Labor Standards Act child labor and wage provisions, in addition to minimum wage and overtime regulations. The company also engages in unlawful and unfair business practices in California.
Other claims in our lawsuit also include unjust enrichment, negligence, violations of fraudulent business practices, specific California violations, and unlawful currency or company scrip.
The Lawsuit Alleges Children Faced Coercive Working Conditions
The children were exploited, often subjected to threats and coercion, and forced to endure working conditions that violate the law.
They didn’t receive work permits. Their parents didn’t know what was going on. They didn’t enter into any valid or enforceable contract with Roblox. In fact, they lacked the capacity to enter into any contract.
Gaming companies created their own company within Roblox using children. These companies reached out to kids directly to hire them through the Roblox site. The same companies also sometimes told the kids to meet them on Discord group chat to talk with them.
The companies made the decisions. The children were caught up in an economic loop of working for others and earning below any form of the minimum wage. With no appropriate parental approval or supervision.
