“At the crux of it, our claim is about consumer protection. These manufacturers make representations about health benefits that are unfounded while failing to warn about health risks,” explains W&L partner James Bilsborrow.
“The defendants boast that their products help with anxiety, sleep, and other health problems. Many of these supposed benefits are unfounded. At the same time, these manufacturers provide no warnings about the very real potential for serious mental health harms. Cannabis-induced psychosis is just one significant danger,” Mr. Bilsborrow adds.
In general, the class action claims are for consumer fraud. The suppliers’ actions led to economic harms because they sold products that simply don’t have the qualities the manufacturers represented. Separate charges named in our suits include fraud, racketeering, negligence, strict liability, failure to adequately warn, breech of express warranty, and unjust enrichment.
Deceptive Marketing Tricked People
These companies didn’t just lie on their product packaging. They promoted their products far and wide on websites, social media, and blog posts. They instructed their employees to misrepresent the benefits of their cannabis products. Employees at dispensaries were also expected to tout the healthful qualities of their cannabis products to customers through personal interactions.
False and misleading statements came in the form of in-store conversations with so called “budtenders,” telephone conversations, and online chat features on the suppliers’ websites. According to the companies we are suing, cannabis products could alleviate everything from depression to glaucoma, epileptic seizures, and pain.
These companies not only sold the cannabis products, they actually strategically created the cannabis market. Their only goal was to increase sales.

The cannabis products sold by the defendants have one main thing in common: tetrahydrocannabinol, or THC. At high concentrations, this chemical is highly dangerous.
These companies knew, or should have known, their recreational cannabis products were not approved by the U.S. Food and Drug Administration as a treatment for any single medical disorder. Also, no reputable, credible, scientific research has shown that recreational, high-THC cannabis is safe and effective for treating anything.
