What is Mesothelioma?

Mesothelioma is an aggressive cancer that forms on protective linings of the chest, the abdomen, the heart and the testicles.1 Many of the 3,000 new cases diagnosed in the U.S. each year can be traced to job-related asbestos exposure.2 3

Mesothelioma usually takes anywhere from 20 to 50 years to develop. Unfortunately, there is no cure for mesothelioma, and the risk of developing the deadly cancer does not diminish over time, even after the exposure to asbestos ends.3

Who Gets Diagnosed with Mesothelioma?

Weitz & Luxenberg attorneys advocate for men and women whose lives were ruined or altered by asbestos. Many of them are spouses of someone with mesothelioma, and sometimes they are veterans who encountered asbestos while serving in the U.S. military. Though asbestos use in the U.S. has dropped dramatically in recent decades, asbestos is still present in older homes and buildings, including some schools. Asbestos is also still used in products such as automobile brakes and roofing materials and is contained in talcum powder products.

The U.S. Occupational Safety and Health Administration (OSHA) has estimated that millions of employees deal with risk in their jobs. Workers in construction and general industries face significant asbestos exposure on the job. People at risk for asbestos exposure in the workplace include some miners, factory workers, insulation manufacturers and installers, railroad and automotive workers, ship builders, gas mask manufacturers, plumbers, firefighters, and construction workers.1 5

Shipyard Workers

In a historic court victory, Weitz & Luxenberg won a verdict of $75 million on behalf of 36 shipbuilders exposed to asbestos at the Brooklyn Navy Yard in the 1940s and 50s.

U.S. Military

Many asbestos victims trace their illnesses back to the military. In fact, veterans account for an estimated 30 percent of those diagnosed with mesothelioma each year.

Boiler Workers

In two separate asbestos cases, Weitz & Luxenberg won $190 million for a group of five boiler company workers and $49 million for a boilermaker who suffered from mesothelioma.

Auto Mechanics

Many auto parts, including brakes and clutches, can release asbestos fibers when they start to break apart or disintegrate due to wear and tear or when they are removed and replaced.

Asbestos-Removal Workers

Weitz & Luxenberg won a $35 million verdict on behalf of an asbestos-removal worker who died from complications related to mesothelioma.

Family Members

Toxic asbestos fibers can collect on clothing, especially in asbestos-heavy work environments. This contaminated clothing can easily pollute the home, placing children and family members at risk of developing asbestos-related diseases.

Jobsite Exposure & Asbestos Discovery

Weitz & Luxenberg has represented more than 33,000 individuals and families who have been affected by asbestos exposure, giving our firm a deep knowledge of worksites across the U.S.

Our firm investigates each case, in an effort to track down the source of asbestos contact. Because we have worked on so many asbestos cases, we’re experts at investigating and determining where people were exposed to asbestos, what products they were exposed to and what company is responsible.

Shipyards

The ability to resist corrosion and high temperatures made asbestos a go-to material for building, repairing, and maintaining ships.

Power & Chemical Plants

Power and chemical plants were rich with asbestos. Employees wore asbestos clothing for protection from heat and chemicals.

Metal Works

With its heat-resistant qualities, asbestos was viewed as ideal for protecting workers and machinery in the metal works industry.

Construction Sites

Both commercial and residential construction relied heavily on asbestos products — it was on roofs, in tile, and mixed with cement.

Military

Veterans who served in certain occupations may have been exposed to asbestos, according to the U.S. Department of Veterans Affairs. 15

Industrial Sites

Workers made an estimated 3,000 products using asbestos, and the industrial uses of the material were virtually endless.

Why Choose Us

We’ve developed winning methods to explain to juries the complicated scientific and medical issues involved in your case. Equipped with our unique insight into asbestos companies and lawyers, we’ve won more than $8.5 billion in asbestos settlements and litigation.

  • We have honed our experience in more than 33,000 asbestos cases.
  • We serve on 25 corporate bankruptcy Trust Advisory Committees.

Defective Drugs & Devices

For people injured by defective drugs or medical devices, Weitz & Luxenberg’s experienced team of attorneys, led by Ellen Relkin, can help discuss your legal options.

How We Can Help

Drugs and medical devices must gain approval from the U.S. Food & Drug Administration (FDA) to be sold in the U.S. However, approval does not guarantee a drug or medical device is safe. In fact, a defect in the product, incomplete labeling, or insufficient warnings can cause physical, psychological, or emotional injury. The manufacturer, not the FDA, is responsible for ensuring that its label is updated to protect the public safety.

Weitz & Luxenberg is committed to holding drug and device makers and marketers accountable for the harm they cause. For 30 years, we have strived to help innocent victims harmed by defective drugs and defective medical devices obtain the justice that they deserve.

”You and your staff are to be commended. I have never been involved in a litigation before and had no idea what would happen. You relieved that tension"

About Dangerous Drugs & Devices

A surgical procedure that’s gone wrong; prolonged pain and weakness; an inability to return to work or resume your normal activities — these are all potential complications, among many others, that can occur as a result of dangerous drugs or medical devices. Such defective medical products can have a negative impact on your life and the lives of your loved ones. In many cases, the injuries caused by certain drugs or devices are more debilitating than the condition that first led to their use. Fortunately, injured consumers can obtain exceptional representation with Weitz & Luxenberg.

How the FDA Defines Drugs & Devices

The FDA defines the term “drug” as a substance:

  • Recognized by an official pharmacopoeia or formulary.
  • Intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease.
  • Intended to affect the structure or any function of the body (other than food).
  • Intended for use as a component of a medicine but not a device or a component, part or accessory of a device.(1)

The FDA defines the term “device” as an instrument, apparatus, implement, machine, contrivance, implant, in vitro reagent, or other similar or related article, including a component part or accessory:

  • Recognized in the official National Formulary, or the United States Pharmacopoeia, or any supplement to them.
  • Intended for use in the diagnosis of disease or other conditions, or in the cure, mitigation, treatment, or prevention of disease, in man or other animals.
  • Intended to affect the structure or any function of the body of man or other animals, and which does not achieve any of its primary intended purposes through chemical action within or on the body of man or other animals and which is not dependent upon being metabolized for the achievement of any of its primary intended purposes.(2)

Current Drugs & Devices Cases

No law firm can restore anyone’s life or health, but Weitz & Luxenberg can help seek compensation through exceptional legal representation for harm caused by drugs and devices, including but not limited to:

Hip Replacements

Some hip implants have inherent problems with their design, which can lead to high failure rates, metallosis, infection, dislocation, or immobility.

Exactech Knee Implants

Some knee implants liners suffer from preventable manufacturing and packaging errors, which can lead to high failure rates, bone loss, and difficulty walking.

Philips PAP, CPAP and Ventilator

Philips announced a voluntary recall of some of its sleep and respiratory care devices in mid-June. The recall was issued for multiple devices, based on the risk of injury.

    Causes of Personal Inury

Motor vehicle accidents are among the leading causes of personal injury. Other causes include:

    Dangerous or Defective Products

Weitz & Luxenberg helped negotiate a more than $1 billion settlement with Stryker for patients injured by hip implants.

    Construction Accidents

We helped secure $2.96 million for a laborer who had part of his leg amputated after an accident at work.

    Medical Mistakes

Our attorneys won $8.5 million for the mother of a child who suffered irreparable brain damage during delivery.

    Medical Malpractice

Though many doctors in the U.S. are skilled and caring, others don’t always put their patients’ needs first. Some physicians have used broken equipment, misdiagnosed patients, or made surgical errors. Unfortunately, these types of mistakes often turn out to be fatal. Patients and their families deserve to be compensated for their pain and suffering.

For more than a quarter-century, Weitz & Luxenberg has been winning complicated medical cases. Since its inception, our medical malpractice team has worked on 1,000-plus lawsuits for wrongful death, injury, and misdiagnosis, recovering $7 million for our clients in one year alone.*

Common Questions about Personal Injury Lawsuits

Many of our clients have never before filed a lawsuit, and the experience can be overwhelming without the proper legal support. That’s why we make sure members of our experienced team are on call 24/7 to answer questions and ensure that all your needs are met. Some common questions include:

    Emotional Suffering, Depression

Your injuries do not need to be physical for you to seek compensation. Emotional suffering is a form of personal injury, too. Examples include depression following the wrongful death of a loved one, or nightmares and insomnia following a car accident.

    Other Causes of Personal Injury

Other causes of personal injury include: assault and battery; false arrest, detention, or imprisonment; slips and falls; wrongful invasion of or eviction from your private home; defamation; and publication of material that violates your right to privacy.

    Selecting the Right Firm

When hiring a firm to represent you, be sure to ask questions about a firm’s experience and its philosophy toward working with clients. Throughout the past 30 years, Weitz & Luxenberg has successfully provided more than 50,000 clients with exceptional and compassionate legal help.

    Wrongful Death Lawsuit

As a surviving family member, you may be able to file a wrongful death lawsuit. In addition, if a family member’s death resulted from negligence, you may be able to receive compensation for your pain and suffering through a personal injury lawsuit.

    Environmental Litigations

Industrial polluters can cause extensive damage to people’s health and livelihood. One of the nation’s premier plaintiffs’ law firms, Weitz & Luxenberg uses its environmental expertise to obtain justice for communities affected by environmental pollution.

    How We Can Help

Despite laws to protect people and the environment, pollution and contaminants generated by companies that negligently handle their chemical waste still poison our air, soil, and water, placing people’s lives and livelihoods in jeopardy. Consequences of corporate misconduct include property damage and plummeting property values. Health hazards include cancer, birth defects, and disabilities.

Weitz & Luxenberg is a large and experienced law firm dedicated to holding accountable those responsible for causing these injuries and making wrongdoers pay compensation to their innocent victims.

    British Petroleum (BP)

    Volkswagen

When tests showed Volkswagen had programmed its diesel vehicles to cheat on emissions tests, Weitz & Luxenberg was one of the first law firms to initiate a class action suit. The subsequent nationwide class action resulted in a $14.7-billion settlement.*

    Contaminants & Their Consequences

The cost of chemical waste disposal generated by companies creates the incentive to pollute — either they spend the money to dispose of the waste safely or they discharge it in an unsafe manner that contaminates the environment, including drinking water.

A company’s improper handling of its waste can result in the contamination of an entire town’s water supply. Oil spills into coastal waters can affect workers in the tourism and fishing industries. And man-made chemicals found in the environment can cause adverse health effects.

Economic impacts of environmental pollution are devastating; the health consequences can be deadly.
